NextMe, Inc. (“Company” or “We” or “Us”) respects your privacy and is committed to protecting it through our compliance with this policy. This policy describes:
- The types of information we may collect or that you may provide when you purchase, download, install, register with, access or use the NextMe App (the “App”).
- Our practices for collecting, using, maintaining, protecting and disclosing that information.
This policy applies only to information we collect in this App, in e-mail, text and other electronic communications sent through or in connection with this App.
This policy DOES NOT apply to information that:
- We collect offline or on any other Company apps or websites, including websites you may access through this App.
- You provide to or is collected by any third party.
Our websites and apps and these third parties may have their own privacy policies, which we encourage you to read before providing information on or through them.
Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, register with or use this App. By downloading, registering with or using this App, you agree to this privacy policy. This policy may change from time to time. Your continued use of this App after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.
Children under the Age of 13
The App is not intended for children under 13 years of age, and we do not knowingly collect personal information from children under 13. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us at [email protected].
Information We Collect and How We Collect It
We collect information from and about users of our App:
- Directly from you when you provide it to us.
- Automatically when you use the App.
How Long We Keep Information
For any free users of the Services (as such term is defined in the NextMe Terms of Use), all user and related business data shall be deleted if said user has not been active (e.g., has not accessed the NextMe platform by logging in to an account, has not modified their data in their NextMe account) for a period of two (2) years.

Information You Provide to Us.
When you download, register with or use this App, we may ask that you provide information:
- By which you may be personally identified, such as name, postal address, e-mail address, telephone number, or any other identifier by which you may be contacted online or offline (“Personally Identifiable Information” or “PII”)
- That is about you but individually does not identify you, for instance, the types of restaurants you like.
This information includes, but isn’t limited to:
- Information that you provide by filling in forms in the App. This includes information provided at the time of registering to use the App, subscribing to our service, posting material, and requesting further services. We may also ask you for information when you report a problem with the App.
- Records and copies of your correspondence (including e-mail addresses and phone numbers), if you contact us.
- Your responses to surveys that we might ask you to complete for research purposes.
- Your search queries on the App.
You may provide information to be published or displayed (“Posted”) on public areas of the app or www.nextmeapp.com (collectively, “User Contributions”). Your User Contributions are posted and transmitted to others at your own risk. Please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of third parties with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.
Email and SMS/Text Messaging.
You can opt out of receiving commercial email or text messages by following the instructions contained in any such message or by contacting Us directly at [email protected].
Automatic Information Collection and Tracking.
When you download, access and use the App, it may use technology to automatically collect:
- Usage Details. When you access and use the App, we may automatically collect certain details of your access to and use of the App and other communication data and the resources that you access and use on or through the App.
- Device Information. We may collect information about your mobile device and internet connection, including the device’s unique device identifier, IP address, operating system, browser type, mobile network information and the device’s telephone number.
- Stored Information and Files. The App also may access metadata and other information associated with other files stored on your device. This may include, for example, photographs, audio and video clips, personal contacts and address book information.
- Location Information. This App may collect real-time information about the location of your device.
If you do not want us to collect this information do not download the App or delete it from your device.
Information Collection Technologies.
The technologies we use for automatic information collection may include:
- Cookies (or mobile cookies). A cookie is a small file placed on your smartphone. It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your smartphone. However, if you select this setting you may be unable to access certain parts of our App.
- Web Beacons. Pages of the App and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an e-mail and for other related app statistics (for example, recording the popularity of certain app content and verifying system and server integrity).
Third-party Information Collection
When you use the App or its content, certain third parties who subscribed to NextMe Services (“Subscribers”) with whom you interact through the App may use automatic information collection technologies to collect information about you or your device. These third parties may include:
- Analytics companies.
- Your mobile device manufacturer.
- Your mobile service provider.
For use with Subscribers relating to health care, government or financial services, NextMe does not collect or store any information that would be designated as protected health, government and/or financial information. NextMe uses best practices in protecting all information transmitted via the App, including encrypting Subscriber data at rest, however it is up to You and any Subscriber with whom You interact via the App to ensure that You and Subscriber are following all standards and guidelines applicable to the protection of any health care, government or financial information. NextMe explicitly states that it does not sell any Personally Identifiable Information or Protected Health Information.
We may use third party tracking technologies to collect information about you when you use this App. The information they collect may be associated with your personal information or other metrics or they may collect information, including personal information, about your online activities over time and across different websites, apps and other online services websites.
Third Party Websites and Services.
Please note that the NextMe App may contain links to other websites and services. We are not responsible for the privacy practices of those websites, and We recommend that you review the privacy policies of each website that you visit. When you select a link to a third-party website from the NextMe App, you will be leaving the NextMe App. Any information that you disclose on the third-party website will be governed by that website’s privacy policy.
How We Use Your Information
We use information that we collect about you or that you provide to us, including any PII to:
- Provide you with the App and its contents, and any other information, products or services that you request from us.
- Fulfill any other purpose for which you provide it.
- Give you notices about your account, including expiration and renewal notices.
- Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
- Notify you when App updates are available, and of changes to any products or services we offer or provide though it.
- Allow NextMe business Subscribers and/or Customers with whom you choose to interact to provide their marketing, advertising, and/or notification materials and information to you.
The usage information we collect helps us to improve our App and to deliver a better and more personalized experience by enabling us to:
- Estimate our audience size and usage patterns.
- Store information about your preferences, allowing us to customize our App according to your individual interests.
- Speed up your searches.
- Recognize you when you use the App.
We use location information we collect to find restaurants and other businesses around you.
We may use the information we collect to allow NextMe business Subscribers to provide advertising, marketing and/or notification information to you. Even though we do not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, marketing and/or notification information, the NextMe business Subscriber may assume that you meet its target criteria.
Disclosure of Your Information
We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.
In addition, we may disclose PII that we collect or you provide:
- To our subsidiaries and affiliates.
- To contractors, service providers and other third parties we use to support our business.
- To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of NextMe’s assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which personal information held by NextMe about our App users is among the assets transferred.
- To fulfill the purpose for which you provide it. For example, if you give us an e-mail address to use an “invite a friend” feature of our Website or App, we will transmit the contents of that e-mail and your e-mail address to the recipients.
- For any other purpose disclosed by us when you provide the information.
- With your consent.
- To comply with any court order, law or legal process, including to respond to any government or regulatory request.
- To enforce our rights arising from any contracts entered into between you and us, including the App EULA, and for billing and collection.
- If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of NextMe, our customers or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
Your Choices about Our Collection, Use and Disclosure of Your Information
We strive to provide you with choices regarding the PII you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of over your information.
- Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the App may then be inaccessible or not function properly.
- Location Information. You can choose whether or not to allow the App to collect and use real-time information about your device’s location through the device’s privacy settings. If you block the use of location information, some parts of the App may then be inaccessible or not function properly.
- Opt-In for Health Care Businesses. For use of NextMe with businesses relating to health care services, we will by default not collect or store any information that would be designated as protected health information. You may request an opt-in status that permits us to collect protected health information and use such information in the manner defined throughout this Policy, however the decision on whether to grant this opt-in to expanded data collection will be determined solely by us. We value your privacy first. Opt-in requests will be denied if we determine that collection of the requested data impermissibly includes protected health information without adequate safeguards to protect the security and privacy of such information.
Accessing and Correcting Your Personal Information
You can review and change your personal information by logging into the App and visiting your account profile page.
You may also send us an e-mail at [email protected] to request access to, correct or delete any personal information that you have provided to us, and such request shall be honored within 14 business days of its receipt. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
If you delete your User Contributions from the App, copies of your User Contributions may remain viewable in cached and archived pages or might have been copied or stored by other App users.
Your California Privacy Rights
California Civil Code Section 1798.83 permits users of our App that are California residents to request certain information regarding our disclosure of PII to third parties for their direct marketing purposes. To make such a request, please send an e-mail to [email protected].
Special Information Regarding Individual U.S. State Laws – California, Colorado, Connecticut, Nevada & Virginia
California
California Shine the Light Requests. If you are a California resident, the California Shine the Light law gives you the right to request information about Our disclosure of personal information to third parties or affiliated companies for their direct marketing purposes. This information would be included in a response to a request to know as set forth below, so you may elect to make that request. Or to make a shine the light request, please contact us by email at [email protected]. For spam filtering purposes, only email with the subject line “NextMe Privacy Request” will be read. We are not responsible for notices that are not labeled or sent properly, or do not have complete information. Please allow up to 30 days for us to process your request. You may submit such a request once per year.
California Privacy Rights (California Privacy Rights Act). If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CPRA”) effective January 1, 2023 provides you with the following rights with respect to your personal information:
- The Right to Know and Access. You have the right to request to know and access the categories and specific pieces of personal information we have collected about you, dating back to January 1, 2022. You also have the right to know the sources from which the personal information is collected, the business or commercial purpose for collecting or sharing personal information, and the categories of third parties to whom the business discloses personal information.
- The Right to Correct. You have the right to request that we amend or update your personal information where it is inaccurate or incomplete.
- The Right to Delete. You have the right to request that we delete any personal information we have collected about you. We will delete your personal information if we have no other no other legal ground or purpose to retain it.
- The Right to Opt-Out of Sale and Sharing of Your Personal Information for Cross-Context Behavioral Advertising. This right provides an individual with the opportunity to opt-out of having their information sold, shared, or used for purposes of cross-context behavioral advertising. the CPRA broadly defines “sale” as any sharing of personal information with third parties in exchange for monetary or other valuable consideration. The CPRA defines “sharing” as sharing personal information with a third party for cross context behavioral advertising (commonly referred to as interest-based or tailored ads). We work with other companies and businesses to deliver interest-based ads to you, which enable us to provide our App and relevant offers to you. In working with other companies and businesses, we may disclose personal information in a way that is “selling” or “sharing” personal information as defined by the CPRA. You may opt out of interest-based audio ads by logging into in your NextMe app account and adjusting your ad preference settings. You can also request to opt-out of the sale or sharing of your personal information for cross-contextual behavioral advertising by clicking on the “Do Not Sell or Share My Personal Info” link at the bottom of our website.
- The Right not to Receive Discriminatory Treatment. Businesses cannot discriminate or retaliate against you for exercising your CPRA rights.
- The Right to Limit Use and Disclosure of Sensitive Personal Information. You have the right to limit the use and disclosure of any sensitive personal information, as defined by the CPRA, that we may collect about you. Unless you are a job applicant or employee, We only use and process the following categories of Sensitive Personal Information:
- Log-in information (account username and password) for the limited purpose of allowing you to access your NextMe account(s);
- precise geolocation when you opt-in to location tracking in your NextMe account;
Please see below for the categories of personal information we have sold or shared about you in the preceding 12 months, as defined by the CPRA. Please be assured that We do not sell your information as the word “sell” is commonly understood; in other words, We do not give your personal information to data brokers or other third parties in exchange for money. However, there are instances where NextMe has shared personal information to help Us improve your user experiences and the relevance of offers made to you through NextMe, and to deliver tailored advertising.
Categories of Personal Information:
- identifiers such as a real name, alias, postal address, unique personal identifier (such as a device identifier; cookies, beacons, pixel tags, mobile ad identifiers and similar technology; customer number, unique pseudonym, or user alias; telephone number and other forms of persistent or probabilistic identifiers), online identifier, IP address, email address, account name, and other similar identifiers;
- Characteristics of Protected Classifications under California or Federal Law, such as your age, date of birth, and sex (including gender);
- commercial information, including records of services purchased, obtained, or considered, and other purchasing or consuming histories or tendencies;
- Internet and other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding your interaction with websites, applications or advertisements;
- inferences drawn from any of the information identified above to create a profile about you reflecting your preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes;
- Geolocation data.

Companies performing cross-context behavioral advertising on Our behalf; and
advertising technology partners that match your data with additional information to serve tailored ads on our Services;
Nevada
Nevada residents only. Nevada residents have the right to request that a company not sell their personal information. This right applies even if their personal information is not currently being sold. If you are a Nevada resident, and would like to submit such a request, you can do so by sending an email to [email protected]. Colorado, Connecticut & Virginia
Colorado, Connecticut & Virginia residents only. As a resident, your rights as a consumer include:
- The Right to Know and Access. You have the right to request to know and access the categories and specific pieces of personal information (also called “personal data”) we have collected about you.
- The Right to Correct. You have the right to request that we amend or update your personal information where it is inaccurate or incomplete.

- The Right not to Receive Discriminatory Treatment. Businesses cannot discriminate or retaliate against you for exercising your privacy rights. The fact that you have elected to exercise these rights will have no adverse effect on the price and quality of Our Services.
- Right to Appeal. if we decline to take action in any privacy request that you submit in connection with the rights described in this Section, you may ask that we reconsider our response by sending an email to [email protected]. You must ask us to reconsider our decision within 45 days after we sent you our decision.
We do not create consumer profiles or automate decisions that produce legal or similarly significant effects concerning a consumer, which means a decision that results in the provision or denial of financial or lending services, housing, insurance, education enrollment or opportunity, criminal justice, employment opportunities, health-care services or access to essential goods or services.
Please note that these rights to do not apply to you in the employment context, such as information about your job application or status as an employee of a company.
International Considerations – Transfer of Data
Please be aware that information you provide to Us or that We obtain as a result of your use of the NextMe App may be collected and subsequently transferred within the United States or to another country in accordance with applicable law, in which case the information may be made accessible to law enforcement and national security authorities of that jurisdiction under laws applicable in that jurisdiction. Our primary headquarters are in the United States. We have affiliates, vendors, advertisers, customers, and other third parties with which We do business in other countries. If we disclose personal information to an individual or entity outside of the United States, we will seek assurances that any information we may provide to them is adequately safeguarded and in accordance with applicable privacy laws. The privacy and data protection laws in the country to which your information is transferred may not be equivalent to such laws in your country of residence. By using the NextMe App or providing Us with your information, you consent to the collection, international transfer, storage, and processing of your information in accordance with this Privacy Policy.
Data Security
We have implemented measures designed to secure your PII from accidental loss and from unauthorized access, use, alteration and disclosure.
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our App, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the App like message boards. The information you share in public areas may be viewed by any user of the App.
Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through our App. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.
Changes to Our Privacy Policy
We may update our privacy policy from time to time. If we make material changes to how we treat our users’ personal information, we will post the new privacy policy on this page.
